Terms & Conditions

This document sets out the terms and conditions that form the contract between the customer and MotoScotland.com. Motoscotland.com is a trading name of MotoScotland Limited, a company incorporated in Scotland with registered number SC440974 and having its registered office at The Maltland, Inveraray PA32 8XG.

Unless agreed in writing by MotoScotland.com, these terms & conditions will apply.

MotoScotland.com may amend these terms and conditions from time to time and the conditions prevailing at the time a customer undertakes any course will prevail.

Training courses: -

Booking and Payment
The acceptance of payment from the customer for any course offered by MotoScotland.com and/or receipt by MotoScotland.com of a completed customer booking form will constitute the point at which this contract is entered into by MotoScotland.com and the customer. MotoScotland.com reserves the right to decline any booking at its discretion with no reason being required to be provided.

Payment may be made by debit/credit card, cheque (made payable to ‘MotoScotland.com’) or cash.  An additional fee may be levied for the use of debit or credit cards.  This fee will reflect the additional third party costs incurred by MotoScotland.com in processing such a transaction.

Payment in full must be made before the commencement of any course.  A £5.00 administration charge is applicable on bookings (for each and every rider) where a deposit and balance is payable. Where MotoScotland.com agrees for a deposit to be paid by the customer, the deposit will be non refundable if a cancellation is made - the balance will be payable one month prior to the date of the training. Any failure to pay the final balance within one month of the actual course date will result in the customer's course being cancelled - any deposit paid will also be lost.

Once a payment has been by the customer, the customer (including any members of his/her group booking) must complete MotoScotland.com's booking form within 14 days. After this period, MotoScotland.com may charge a reasonable administration fee for each and every weekly reminder email it has to send until the booking form is received. These charges must be paid 14 days prior to the course commencing or the course will be cancelled and no refund will be given. Where there is more than one customer in a booking (group booking), all members of the group must have the required details completed on the MotoScotland.com (online) booking form.

Within 5 working days of receipt of payment in full, MotoScotland.com will email or write to the customer confirming such receipt, the date of the course, directions to the training centre and other important information.  A copy of these terms and conditions will be included in such communication.

Gift vouchers are valid up to 9 months (the actual valid to date will be detailed on the voucher) from the date of issue and can be redeemed against training courses or tours.  Gift vouchers can be used as specified on the voucher or upgraded to any other training course or tour offered by MotoScotland.com for any additional cost. Gift vouchers are non-refundable in any part. Gift vouchers which are allocated to a person's name are not transferable to another person.

The customer agrees that his email/contact details (and those of any members in any group booking he is making a booking(s) for or connected with) will be added to MotoScotland.com's secure database. The customer agrees that from time to time, MotoScotland may email or contact him with offers or other relevant information. The customer can unsubscribe/opt out from these emails by clicking on the relevant link in any email he receives.

Where MotoScotland offers a specific discount code, offer, etc., the code can not be used in conjunction with any other discount code/offer, etc.. Discounts can be used in conjunction with any vouchers the customer may have received.

Amendment and Cancellation
The customer may cancel any booking by informing MotoScotland.com in writing (via mail or email).  MotoScotland.com will acknowledge and confirm such cancellation within 7 days – until the customer has received this confirmation the original booking remains valid.

MotoScotland.com may cancel the customer’s booking by giving the customer 14 days’ notice of any such cancellation and will then offer the customer either a refund or alternative dates.

MotoScotland.com may cancel or transfer the customer’s booking for operational reasons (including adverse weather or unplanned fleet or personnel shortages) with less than 14 days’ notice (including on the date of the course’s commencement).

Where a course is cancelled the following table summarises the outcome:

* In accordance with the Consumer Contracts Regulations, which implement the Consumer Rights Directive in UK law.

Customers who are late for the course may be excluded – no refund of the fee will be given.

The customer may request, more than 30 days in advance of any planned course commencement date, a transfer of the booking to another date within six months of the original date.  Subject to the payment of a £20 transfer fee and course availability, MotoScotland.com will agree to such a transfer and will notify the customer in writing of the new course date.  Only one transfer may be made and the customer will be liable to pay any difference between the cost of the original course and the published cost of the course to which the transfer is being made.  Failure to make any payment required prior to the commencement of the course will result in cancellation of the course without compensation to the customer. Once a course date has been transferred, a cancellation refund is no longer applicable.

No transfers will be permitted by the customer within 30 days of the planned commencement of any course.

MotoScotland normally needs a minimum number of people to attend a course to make it viable. Where a booking is for 2 people or less and the minimum number of people required has not been met, MotoScotland reserves the right to transfer the booking to a different date to be agreed with the customer (the new course date to be within 6 months of the original booking date). If a booking date transfer becomes applicable, MotoScotland will notify the customer of the possibility of this transfer as soon as possible, and in any event, within 7 days of the actual date of the training course. Customers can contact the booking office on 01499 320460 or by email at info@motoscotland.com should they need confirmation that the minimum course number has been reached at any time.

Where MotoScotland.com makes a booking for accommodation with any accommodation provider on behalf of a customer, the customer agrees to familiarise himself with that accommodation provider's individual cancellation policy and accepts full responsibility and liability for any cancellation fees that apply as a result of the booking.  The customer accepts that MotoScotland.com will not be liable for any costs, etc., in  respect of the accommodation provider being able or not being able to deliver any or all of its service(s).

Where MotoScotland has to cancel or transfer any course/booking, it will not be liable, whatsoever, for any associated costs (e.g. accommodation/travel/hire, etc.) the customer may or may not have to pay as a result. In such unusual instances, MotoScotland will endeavour to offer alternative dates or a training course voucher (as it sees fit).

Insurance & Driving
The customer must be aged 18 or over and hold a current motorbike license for riding a motorcycle which is valid in the UK (for the duration of the course) and must produce the original license (paper and plastic part where available) for inspection before partaking in any course.  Customers with a Compulsory Bike Training (C.B.T.) certificate must notify MotoScotland of this to ensure a suitable powered motorcycle can be provided. No customer who has been disqualified from driving or has a conviction for any driving offence involving alcohol or drugs within the previous five years may partake in any course – no refund will be given.

The customer must inform MotoScotland.com of any motoring conviction or offence which is pending at the time of the course.

The customer will be liable for any losses or additional costs incurred by MotoScotland.com as a result of their failure to inform MotoScotland.com of any relevant information in respect of the status of their driving license.

The MotoScotland.com provides insurance cover in respect of third party road risks only.  The customer agrees to co-operate in full with MotoScotland.com in the event that any incident involving the customer occurs which is subject to any insurance claim.  Such co-operation will include, but will not be limited to, the provision by the customer in a timely manner of a written statement in respect of any incident and the provision of any further information reasonably required by MotoScotland.com or its insurers.

Safety is paramount at MotoScotland. No personal accident insurance is provided by MotoScotland.com and customers should consider purchasing such insurance.

The customer fully understands that off road motorcycle activities can be dangerous. MotoScotland.com accepts no responsibility or liability for any loss, damage, personal injury or death to the customer whilst partaking in any course.  

The customer will be liable for any losses or additional costs incurred by MotoScotland.com where an insurance claim is made as a result of his/her actions while participating in training. Where a customer has 6 or more points or a serious driving offense e.g. drink driving, etc., on his licence, the insurance excess can be £1000 or higher. The minimum customer insurance excess is £500.  Invoices for excesses or damage must be paid within 7 days of the invoice date to avoid debt collection charges being added to the cumulative total.

During the course, the customer may be required to use public highways to link off road tracks and trails.  The customer accepts full responsibility for his/her conduct during the course, including following the Highway Code and any legal requirements to ride a motorbike on a public highway.  The customer is solely responsible for any liability/costs and for any penalty points/fines for speeding or similar that s/he incurs during the course or whilst using one of MotoScotland.com’s motorcycles.

MotoScotland.com accepts that some reasonable damage may occur to the motorbike(s) and protective clothing/kit that is hired to the customer during the Training. Where MotoScotland.com deems damage to be excessive, the customer agrees to pay MotoScotland.com for any costs (including debt collection costs) of such kit/clothing, parts and labour, etc., as required to repair damage to the motorbike within 7 days of receiving an invoice.  If the customer damages the motorbike hired to him to the point of it being impossible to continue, then the training may be deemed by MotoScotland.com to be over – no refund of the fee will be given

MotoScotland.com reserves the right to change or alter the course or event structure as it deems necessary. However, MotoScotland.com will endeavour to maintain the same level of quality & value where applicable.

MotoScotland.com will assist customers to identify suitable track/trail routes through communication, however, it remains the responsibility of customers to use their own judgement to determine route suitability for and within their capabilities.

Customer Health & Fitness
The customer acknowledges that the courses provided by MotoScotland.com can be physically demanding and require an appropriate level of fitness and good health.  

The customer will, prior to the commencement of any course, inform MotoScotland.com of any relevant medical conditions that could affect him/her or others whilst undertaking the course.

Where food is provided by MotoScotland.com, the customer is totally responsible to satisfy himself that it is suitable for his diet (in particular when he has an allegy(ies) or special dietary needs). Due to its remote location, certain foods for special dietary needs may be difficult for MotoScotland.com to provide. MotoScotland recommends that customers with special diets and health needs bring any special foods/snacks they may need and check with MotoScotland.com about what is to be provided.

Motorcycle and Equipment Provision
Where included in the price paid by the customer, MotoScotland.com will provide a motorcycle for the duration of the course.  Every effort will be made to provide the customer with the model of motorcycle requested but MotoScotland.com may substitute alternative models.  Any motorcycle so provided will be road legal and have been checked by MotoScotland.com prior to the commencement of the course.  The customer must inform MotoScotland.com immediately of any concerns relating to the operation of the motorcycle or any accident or incident that may affect the safe operation of the motorcycle.

MotoScotland.com may provide, at the request of the customer, protective helmet, clothing and boots for the duration of the course.  The provision of such equipment may be subject to additional fees as advertised from time to time by MotoScotland.com. A deposit may be required by MotoScotland.com. The Company accepts no liability or responsibility for any injuries that may occur from the provision or non-provision of these items.

Customer’s own motorcycle
Customers may only use their own motorcycle on a course where such use has been agreed in writing in advance by MotoScotland.com.  The customer will sign a suitable disclaimer in respect of the use of their own motorcycle and will be responsible for any loss or damage, to the motorcycle or to any other property or third party, by him/her or the motorcycle.  

The customer must ensure that the motorcycle is taxed, with valid insurance covering the activities being undertaken on the course and roadworthy (with a valid MOT certificate where required).  MotoScotland.com may refuse or withdraw the customer’s right to use their own motorcycle where it is not satisfied as to the suitability and condition of the vehicle or that valid insurance/road tax/ MOT is in place – no refund will be made.

MotoScotland.com will not be liable for any loss or damage to the customer’s motorcycle no matter how it is caused.

The customer is responsible for any costs of recovery or repair to their motorcycle whilst partaking in the course.

Minimum Equipment Standards
Any protective clothing, boots or helmet (EC2205 or equivalent) provided by the customer must be in good condition and MotoScotland.com may refuse access to the course if such equipment (or its condition) does not meet its minimum standard or is not correctly used – no refund will be made.

Safety and Instruction
Off road motorcycling is an inherently dangerous activity.  The safety of customers and staff is a priority for MotoScotland.com and, therefore, each customer is required to comply with all safety guidance and any instructions given my MotoScotland.com’s staff at all times.  

MotoScotland.com reserves the right to require any customer to leave the course or transfer to a different level of course if it believes that it is unsafe for him/her (or other customers who may be affected) to continue or if s/he persistently fails to follow instructions given to him/her by MotoScotland.com’s staff.  In the event that the customer is required to leave for such a reason no refund or alternative course will be offered.

Every customer has a duty to behave with due regard to the inherent risks of motorcycling and to mitigate such risks.  In particular, the customer is expected to respect the requirement of MotoScotland.com and other customers to enjoy a safe and well co-ordinated experience.  MotoScotland.com may require the customer to withdraw from the course where the customer’s behaviour is unsuitable (in particular, behaviour which is dangerous or disruptive and places at risk the customer’s own safety or the safety of others).  Any damage to property or equipment as a result of inappropriate behaviour will be a liability of the customer and recovered from him/her.

Personal Information
The customer acknowledges that MotoScotland.com will require to make copies of the customer’s license and other documentation and store personal details as part of its business.  The customer authorises MotoScotland.com to make such (paper and electronic) copies and to hold the copies and other personal information securely.  The customer agrees that MotoScotland.com may use third party(ies) to process his/her personal data – any such processing will be done in accordance with MotoScotland.com’s General Data Protection Regulation Policy and relevant practices set out by MotoScotland.com.

The customer authorises MotoScotland.com to make contact via email, phone and by letter in respect of any booking or proposed booking and to make the customer aware of MotoScotland.com’s future courses and activities.

The customer agrees to not use any film footage taken other than for personal use - film footage must not be published in any medium, e.g. internet, etc., under any circumstances.  The customer agrees to seek permission for filming from other people who may be present before any fiming commences.

The customer agrees to MotoScotland.com using images or film it takes to be made available on its online photo imagery sites and general marketing media. The customer agrees that any photography or film taken during their time with MotoScotland.com (whether by the customer or the MotoScotland.com) will be owned by MotoScotland who shall retain title and copyright. The customer will be sent a link to the images where he/she can download them.

MotoScotland.com shall not be liable under any circumstances for any loss, damage, costs or expenses suffered or incurred by the Customer (whether direct, indirect or consequential) arising from, or in any way connected with any course or its failure to provide or deliver the course or any part of the course. For the avoidance of doubt tMotoScotland.com does not exclude liability for death or personal injury arising from its own negligence.

All notices which are required to be given in accordance with this Agreement shall be in writing and may be delivered personally or by first class prepaid post to the registered office of the Company or the known home address of the Customer upon whom the notice is to be served or any other address that the party has notified the other party in writing, by email or facsimile transmission. Any such notice shall be deemed to have been served: if by hand when delivered, if by first class post 48 hours following posting and if by email or facsimile transmission, when that email or facsimile is sent

If any of the provisions of these Terms and Conditions shall be determined by any competent authority to be unenforceable to any extent, such provision shall, to that extent, be severed from the remaining terms, which shall continue to be valid to the fullest extent permitted by applicable laws

Governing Law
These terms and conditions are subject to the laws of Scotland and the exclusive jurisdiction of the Scottish Courts.


Retail Goods: -

1.1 All prices are quoted in British Sterling and are inclusive of V.A.T. where applicable.
1.2 All prices are plus postage from an appointed courier. Deliveries will only be made in the UK mainland. Where postage charges are higher than stated due to the customer’s location, the customer will be informed and can make the choice to cancel the order and receive a refund.

2.1 Payments must be made in British Sterling unless otherwise specified, and by one of the following payment methods:
Major credit cards as listed: Visa, MasterCard, Delta, Switch, Maestro and Visa Electron. Your card is charged when your place your order.
Cash (in person).
Cheque (payment must have cleared before goods will be dispatched).

Goods shall remain the property of MotoScotland.com until full payment has been made by the customer and cleared.

The risk in the goods shall pass to the customer on delivery, as defined in clause 5 below.

Any date or period for delivery shall be considered as indicative only, although it is our policy to try to despatch all orders within 5 working days. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the manufacturer. MotoScotland.com cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party. Orders will be shipped via a suitable courier. Most packages arrive within 5 business days. MotoScotland.com has the right to fluctuate prices in proportion with their costs. Where goods are on back order, the customer will be notified and can make the choice to cancel the order and receive a refund.

PASSING OF RISK In the event of an order being lost by a third party, MotoScotland.com bears no risk once it has left their trading premises. Where goods have been received damaged, a refund/exchange application will only be acknowledged if the goods are returned together with their original packaging within 14 days of order to MotoScotland.com’s trading address (see clause 12).
Where the goods are signed for, if a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.
In the event of either of the above, MotoScotland.com will forward a claim to the courier: on behalf of the customer.
To initiate a product return please follow the instructions listed in Clause 7.
This is not a guarantee and MotoScotland.com has the right to refuse any application. Any refund/exchange given is at the discretion of the management of MotoScotland.com. Failure to give accurate information while making a claim may lead to a prosecution from the appointed courier.

The customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 14 days after their receipt the customer shall have notified the MotoScotland.com that the goods are rejected. (This does not however affect the customer’s statutory rights). If no such action has been taken, MotoScotland.com shall consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any reject at a later date.

7.1 If the goods are to be rejected in the time limit set in clause 6 above, the customer shall comply with the return procedure as defined in clause 7.2, below. MotoScotland.com will not accept any returned goods should the return not follow the aforementioned return procedure.
7.2 The customer must email clive @motoscotland.com within 14 days of the receipt date to advise the order number and the exact issue with the product. MotoScotland.com will then advise the next steps to take in writing - normally within 5 working days.
Any opened or damaged products will not be eligible for a refund/exchange. You must obtain a certificate of posting.
7.3 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to MotoScotland.com before the refund or replacement can be issued.
7.4 In cases where the rejection is due to an incorrect order from the customer or to dissatisfaction, the customer may be entitled to a partial refund (full refund less postage costs) only. Goods must be returned to MotoScotland.com before the partial refund can be issued.
7.5 In cases where the customer does not sign for the goods on delivery or for whatever reason, they are not accepted by the customer and returned, we will offer either to re-send the package (which will incur the original shipping charges again), or to refund the original payment minus shipping charges.
NB. Only goods purchased from MotoScotland.com by the customer can be returned and exchanged by MotoScotland.com. (items distributed by MotoScotland.com, but purchased from a 3rd party supplier must be returned to that supplier)

8.1 Cancellations are only accepted if the customer complies with the following cancellation procedure and before the order has been despatched. If the order has been despatched prior to the cancellation, the return procedure as defined in clause 7 (7.2 and 7.4) above will apply. If the procedure is not respected, the order will be considered valid and the customer will remain liable for the full payment.
8.2 Cancellations can be made via MotoScotland.com email address clive @motoscotland.com. If the goods have already been despatched, MotoScotland.com cannot refund any monies spent on postage & packaging (clause 7.2 & 7.4).

Any information passed through to MotoScotland.com is via a secure connection on the internet using Secure Socket Layer technology. If a customer wishes for their information to be removed from our database, this should be requested in writing at our registered office (please see below) or to clive @motoscotland.com.
Please note - credit card details are not retained. The only information stored is a customer's transaction history, plus address and contact details as entered in the account setup process. These may be used for marketing purposes by MotoScotland.com only. Customers will not be sent 'spam' e-mail. Should any customer not want their details used for marketing purposes, please unsubscribe using the appropriate link.

The customer shall respect all licence agreements delivered by the copyright owners. MotoScotland.com cannot be held responsible or liable for any misuses conducted by the customer or any third party. All trademarks shown on www.motoscotland.com belong to their registered owners and must not be copied without prior permission.

11. LAW
These terms and conditions are governed and shall be interpreted in accordance with Scottish Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.

Motorbike Purchase Terms & Conditions: -

These terms and conditions apply each time we sell a motorcycle (BIKE/bike) to you (the Customer), whether the purchase is completed in person, over the telephone, post or email. Please read them carefully before buying a motorcycle from us.

Nothing in these terms and conditions affects the statutory rights of consumers.

References to "MotoScotland.com", “we/us/our” relate to Moto Scotland Ltd trading as "MotoScotland.com".
References to “you/you/your”, “Customer” relate to the customer who pays for the bike sale.

1. Acceptance of our Sale Price & Order Process

You agree to pay the full price for the bike as advertised and quoted (unless a different price has been provided to you in writing from MotoScotland.com).

For new bike sales only:
Upon receiving full payment from the Customer for the bike and the On The Road Charges, MotoScotland.com will order the new motorbike from the relevant bike manufacturer. MotoScotland.com is due to pay the full amount to the manufacturer once an order is placed and the Customer agrees that he/she cannot cancel the purchase transaction after he/she has made a full payment to MotoScotland.com.

New bikes will typically be supplied as described in the specification sheet, however, the Customer agrees and accepts (without prior notification) that the supplied bike may have minor manufacturer variations, e.g. different tyre brands, etc..

MotoScotland will be notified by the manufacturer the expected shipping date to MotoScotland.com. The Customer agrees and accepts that this is a guidance date and can change due to conditions beyond the control of MotoScotland.com. MotoScotland.com will keep the Customer appraised of the expected delivery date as it is advised of it (and any subsequent changes).

The Customer is required to collect the bike, by appointment, within 7 days of the actual delivery date given by MotoScotland.com (unless agreed in writing by MotoScotland.com). The customer agrees to pay MotoScotland.com £20/week storage fees weekly if he/she collects the bike after this period. If the bike is not collected within 26 weeks of the delivery date given, the bike’s title and ownership will return to MotoScotland.com who may sell the bike to another customer.

The price quoted is based on the Customer collecting the bike. The Customer will notify MotoScotland.com in writing if he/she is using a bike collection service or another third party to collect his/her bike and that the party (including the Customer) collecting the bike for him/her will need to provide identity (passport or driving license) before the bike is released by MotoScotland.com.

MotoScotland does not provide a bike delivery service. It is the Customer’s responsibility to satisfy him/herself that any bike being collected is secured suitably/safely, and to his/her satisfaction. MotoScotland.com is not responsible for securing the bike and any subsequent damage that may occur.

Upon receipt of your bike you will be asked to sign for the goods received in good condition. If the bike does not appear to be in good condition then please inform us of any defect before signing.

For used bike sales only:
Road tax will not be included in any agreed sale price. The bike’s MOT validity duration, where applicable, will be provided to the Customer (either by the advert or in response to a request from the Customer).

Used bikes are sold as seen and be supplied with only those parts/accessories as described in the advert. MotoScotland.com will either take a full payment from the Customer for a used bike or a deposit (10%) and the final balance should be cleared funds with MotoScotland prior to collection of the bike. Where a deposit is paid, the Customer will pay and collect the bike within 30 days of the date the deposit was paid. Where the customer does not pay the full balance within 30 days, he/she agrees that he/she will have lost the deposit paid and the sale of the bike will be cancelled.

MotoScotland will agree, in writing, when the bike will be available for collection. That date may be varied by MotoScoltand.com in writing from time to time.

The Customer is required to collect the bike by appointment, within 7 days of the actual collection date given (unless agreed in writing from MotoScotland.com). The customer agrees to pay MotoScotland.com £20/week storage fees weekly if he/she collects the bike after this period. If the bike is not collected within 26 weeks, the bike’s title and ownership will return to MotoScotland.com who will be able to sell the bike to another customer.

The price quoted is based on the customer collecting the bike. The customer will notify MotoScotland.com in writing if he/she is using a bike collection service or another third party to collect his/her bike and that the party (including the Customer) collecting the bike for him/her will need to provide identity (passport or driving license) before the bike is released by MotoScotland.com.

MotoScotland does not provide a bike delivery service. It is the Customer’s responsibility to satisfy him/herself that any bike being collected is secured suitably/safely, and to his/her satisfaction. MotoScotland.com is not responsible for securing the bike and any subsequent damage that may occur.

Upon receipt of your bike you will be asked to sign for the goods received in good condition. If the bike does not appear to be in good condition then please inform us of any defect before signing.

2. Price Quoted

Whenever we quote a Price, that Price is in Pounds Sterling and is inclusive of United Kingdom rated VAT where applicable. You are responsible for the disclosure and payment of any duties or other taxes which apply. Our VAT number is 208 0621 43.

All prices quoted are given in good faith and are derived from a combination of factors including the information supplied by the manufacturer and Customer. The provision of inaccurate, false or misleading data by the Customer could result in MotoScotland applying additional terms and charges to this agreement which the Customer will reasonably agree to.

The price quoted for a new bike does not include On The Road Charges of £200 which includes the bike being built by MotoScotland.com, pre-delivery bike inspection, road tax and all other actions required to make the bike road legal/ready. The Customer (unless agreed otherwise by MotoScotland.com in writing) agrees to pay these charges in advance of collecting the bike.

We will ask to collect your bike at an agreed address (in mainland Scotland) that we provide when selling you a bike.

Whilst we try to ensure that all Prices provided on our website, in our literature and given over the telephone are accurate, mistakes can sometimes occur. If we discover an error in the Price we will contact you as soon as possible and give you the option of either reconfirming your Offer at the correct Price or cancelling it. If we are unable to contact you we will treat the contract as being cancelled. No liability whatsoever can be accepted by MotoScotland.com for accidental mistakes or errors caused by system failures.

3. Payment

Payment can be made in cash, cheque or debit/credit card. The customer agrees to pay a surcharge of 2% to cover costs incurred by MotoScotland for payments by debit / credit card.

Interest on monies outstanding and payable to MotoScotland.com shall be payable at a rate of 4 per cent per annum above the Co-Operative Business Bank, base lending rate prevailing at the time and shall accrue at a daily rate from the day on which amounts due and payable to MotoScotland.com are unpaid up to and including the date when such amounts are paid to MotoScotland.com in full.

4. Your Warranties

AJP Motorbikes come with a 2 year manufacturer warranty from new. If you buy a used AJP, you will have the benefit of any balance of the 2 year warranty. The warranty is only valid where the bike has been serviced and maintained in line with the manufacturer’s instructions and where the bike has not been modified. Other bike brands sold do not come with a warranty unless specified in writing by MotoScotland.com.

5. Conditions of the Contract

MotoScotland.com does not offer part-exchanges on new/used bike sales.

Used bikes that are from MotoScotland.com’s off road training school may be used for training up and to the point of collection by the Customer (unless otherwise agreed in writing by MotoScotland.com).

No contract exists between you and MotoScotland.com for the purchase of any goods until MotoScotland.com has received and accepted your order in full and a payment is received by MotoScotland.com.

MotoScotland.com has the right to terminate this agreement in the event that the goods are unavailable, mis-priced (either selling or buying price from the manufacturer), adverse fluctuation in price from the manufacturer or an error in prices or cleared funds are not received.

6. Collection By You

When you collect the bike we will provide to you the following items (where applicable and available):

All keys and other items necessary to fully operate the bike;
The bike's service records, invoices and relevant paperwork;
The bike's V5 (also known as the log book);
The bike's manuals;
Any original equipment

You will take title/ownership to and risk in the bike when you take physical possession of it. Titel/ownership of the bike shall not pass to you until MotoScotland.com has received in full (in cash or cleared funds) all sums due to it in respect of:
i) the goods, and
ii) all other sums which are or which become due to MotoScotland.com from you (i.e. storage pre-delivery)
MotoScotland.com shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from MotoScotland.com to you.

We, our directors, employees and other agents shall not be liable for damages of any kind including without limitation, direct, indirect, special or consequential damages, loss of income or profits, loss of or corruption of data, loss of or damage to property or claims of third parties, arising out of or in relation with your purchase of the bike or the late or non-collection of the bike.

We do not limit or exclude our liability for death or personal injury caused by our negligence or any rights you may have as a consumer to the extent that such liability and rights may not be limited or excluded under applicable law.

9. Validity

If any of these Conditions of Purchase are unenforceable it shall not affect the enforceability of the rest of these Conditions of Purchase.

10. Variation

Other than as provided in these Conditions of Purchase, nothing said or implied by our employees or sub-contractors shall amount to a variation of these Conditions of Purchase or a representation about the nature or quality of our products.

The terms of this agreement cannot be varied by oral representation or otherwise. No variation or alteration of this agreement shall be of any effect unless such variation or alteration shall have been previously agreed by a Director of the MotoScotland.com in writing.

11. Trademarks, logos and copyrights

The trade marks, logos and service marks (collectively “the Trade Marks”) displayed by MotoScotland.com (whether registered or unregistered) are and shall remain the property of their respective owners. Nothing
